§ 1 General Commercial Conditions

All contracts and achievements are based exclusively on account of the general commercial conditions at the time of the orders valid version with Perlorado.de Kien Osburg GbR (following named Perlorado).

§ 2 Contractural Relationship and Withdrawal

1. Offerts contained in announcements, leaflets or within the scope of Internet advertisements are non-commitable.

2. Orders placed via Internet by using the Button 'checkout' or upon receipt of incoming orders by E-Mail or Fax are considered a binding contract offer.

3. In case of Non-availability of the articles ordered, Perlorado is obligated to inform the customer accordingly and to re-imburse costs already occurred to the customer in case of a non-delivery situation.

4. We refrain ourselves – according to our appraisal – from risky businesses, to refuse an order confirmation and to reject a bill of sale.

5. The completion of the contract occurs through the acceptance of Perlorado by means of a confirmation by E-Mail, Fax or letter or through sending of the ordered product.

6. With the confirmation of order the buyer recognises our delivery and payment terms. For errors which can occur i.e. by telephone or long distance transmission, we take over no liability.

§ 3 Customers Information Duty

The customer is obliged with the registration to give truthful information. Data changes, especially Name, Address, eMail-Adress, Telephone No. or Bank Datas have to be reported immediately to the Webshop.
If the customer omits from this information or gives wrong datas from the start, Perlorado can withdraw from the contract. The resignation is explained in writing , the written form is also accepted by Telefax or eMail. Costs occurred by such an omission or due to wrong original data information, have to be carried by the customer.
This concerns in particular the costs for wrong payments and leads to the return of the product. For the foreign costs Perlorado calculates a handling fee of 10 Euros.

§ 4 Delivery, Despatch, Danger Crossing and Terms of Delivery

Deliveries are only possible within Germany and EU-Countries.

Perlorado delivers the following product with pearl jewellery:

Perl jewellery as ordered - protected in a material bag by post, parcel or by registered letter. The assortment exists primarily of freshwater cultured pearls which occur in a huge number of natural colours. Merely the pearls in silver-grey and anthracite are colour-treated. Perlorado disposes of the buyer Pearls jewellery which were not produced by themselves but are covered by different manufacturers.
Perlorado guarantees that the Pearl jewellery corresponds with the described quality, was imported properly to Germany and the suitable taxes were paid.
The parcel is addressed with the delivery address from supplier and sufficiently stamped.
Parcels are insured by the German Post AG up to Euro 500. Registered letters are insured up to 25 Euro. Orders with a higher order value are insured by us accordingly.
The business is concluded by handing over the parcel to the German Post AG to the customer or by a representatives, (e.g. Pickpoint), and the danger is passed onto the customer.
The dispatch takes place within 2 working days after receipt of payment, and availability of the goods. Duration of delivery within Germany usually takes 2 working days.
Given terms of delivery and availability of quantity mentioned in the online shop are without guarantee.
Delays of delivery caused by legal or official orders are not to be represented from Perlorado and extend the term of delivery according to the duration of the obstacle.
Perlorado informs the customer about any delays of delivery immediately.
Compensation claims against Perlorado only exist if the delay and intention is based on coarse carelessness. Unless confirmed in writing, we can not be made liable for keeping the delivery terms.
The liability in the case of an in writing confirmed date of delivery limits itself exclusively to the free taking back of the late delivered product.

§ 5 Prices, maturity and payment

The purchase price matures immediately with order. All prices are final prices and include value added tax.
For deliveries within Germany the following expenses occur:

- Order Value up to 50,- Euro: 3.60 Euro despatch costs
- Order Value from 50,- Euro: - free of charge

The invoice amount for orders within Germany is paid alternatively by cash in advance (transfer) Invoice (up to 50 Euro of invoice amount), Paypal or cash-on-delivery.

Payment by cash-on-delivery:
a fee of 3,- Euro; delivery by DHL: 2,- Euro will be charged.

For the dispatch in EU-countries the expenses amount to 8 Euro. Customers outside Germany can pay only by Bank transfer (cash in advance) or Paypal.
Payments by transfer: After monetary receipt Perlorado will dispatch the ordered goods.

Mistakes, input errors, misprints as well as technical changes are under proviso.

§ 6 Compensation, retention

A right of compensation is entitled to the customer only if his counterclaims are ascertained legally or are recognised by Perlorado.

§ 7 Rights

Up to entire settlement of all claims existing towards the customer the delivered product remains in the property of Perlorado.
With behaviour contrary to the terms of agreement by the customer, Perlorado is entitled to take back the product; the customer is obliged to hand over the goods. The customer carries the cost for return plus a fee of 10,-- Euro

§ 8 Warrant of merchantability and Liability

In case of any damage or faults of the products, legal regulations are accountable.

§ 9 Protection of Datas

The Data of the orderer becomes exclusively the purpose of the conclusion and the account related. We store your order data and send you these together with our General Commercial Conditions via E-Mail. The datas can be looked up at any time by using our customer log-in-facility.

§ 10 Warranty

Orders can only be accepted from customers within the Federal Republic of Germany as well as from EU Countries. In case of neglectance Perlorado takes the right to dissociate or step back from the business.

§ 11 Realisation of Business

The business will commence once the customer has paid off the product and Perlorado despatched the goods, i.e. Deutsche Post. This can also take place by an assigned person (Pickpoint). As proof of despatch the confirmation of the German Post Office is considered.

§ 12 Disclaimer of liability

For the availability of the offered goods we cannot take over liability.
Our products are natural products and therefore of unique origin.
The product shown on our web site Perlorade.de can deviate regarding the colour, surface, size, etc. from the original product.
We are not responsible for inappropriate use of the commodity.
Proves the buyer a damage, which is caused by quality shortfall of the supplied commodity, then the purchase price which was allotted to the used up quantity is to apply as maximum amount developed damage. Other and further claims are excluded in any case.

§ 13 Cancellation instruction - Cancellation Rights

The customer is entitled to revoke from the contract explanation within two weeks without information of reasons in textform (i.e. Letter, Fax, EMail) or by returning the matter.The frist begins at the earliest with receipt of the goods and a detailed cancellation instruction in text form. For the protection of the cancellation term the return of the cancellation rights or the procedures in time are required.

The cancellation right does not exist with distant sales contracts for the delivery of goods which are made to customers specification or measured unambiguously on the personal needs.

In case of an effective cancellation the achievements received on both sides and thereof participated use( i.e. interest) are to be returned. If you cannot refund the received achievement to us to totally or partly or only in a less genuine condition, you must carry to that extent if necessary indemnification according to value for us.
With the returning of goods this does not count if the deterioration of the thing is to be led back exclusively on their check - as it would have been possible to you i.e. in the retail shop.
You can avoid the value obligation to indemnify, while you do not take the thing like your property in use and omit from everything what impairs their value.
Ready for despatch things are to be sent back.
Customer have to carry the costs of the return if the delivered product of the ordered ones corresponds and the price does not exceed the amount of 40 Euro or partial payment (agreed by contract).
Otherwise the return is free of charge for you.
You must fulfil obligations to the allowance of payments within 30 days after sending your cancellation explanation.

§ 14 Juridical regulations of the customer

The customer has to perform to the juridical regulations of his country and to fulfil all conditions. Perlorado explicitly stress that they cannot take over guarantee and responsibility for any sedate offence of the customer.

§ 15 Applicable law

Only the German Law is applicable (under recourse of UN-purchase rights).

§ 16 Copyright & external links (disclaimer of liability)

1. All brand names mentioned on this website are registered brands or brands of the respective owners. Offence against brand rights or responsible institutions will be respectively pursuit.
